If your business is based in the UK and you do not have a physical establishment within the EU, you will need to take action before the Brexit transition period ends if the following scenario is true.

You will continue to process or sell data relating to EU subjects after the 31st December 2020. In this scenario you must appoint an EU representative to remain GDPR compliant.

If your business is based in an EU country but you do not have a physical establishment within the UK, you will need to take action before the Brexit transition period ends if one of the following scenarios is true.

You will process or sell data relating to UK citizens only. In this scenario you will need to apoint a UK representative.

You will process or sell data relating to both EU and UK citizens. In this scenario you will need to appoint a UK representative.

If your business is based in Canada (or another non-EU/UK country), you will need to take action if any of the following scenarios are true.

You will process or sell data relating to UK citizens only without a physical establishment in the UK. In this scenario you will need to appoint a UK representative.

You will process or sell data relating to EU citizens only without a physical establishment in the EU. In this scenario you will need to appoint an EU presentative.

You will process or sell data relating to both EU and UK citizens without a physical establishment in either the EU or UK. In this scenario you will need to appoint both an EU & UK representative.
